This website and/or its mobile applications (the "Site" or "BookABuoy Sites") is owned and operated by BookABuoy, a New Zealand business. Throughout the Site, the terms "we," "us" and "our" refer to BookABuoy. BookABuoy offers this Site, including all information, tools and services available from this Site, to you, the user, conditioned upon your acceptance of these Terms of Use.

1. The Site as a Venue

BookABuoy is an online marketplace that connects mooring owners with sailors. We are not a party to any rental agreement between owners and sailors. We provide the platform, tools, and payment processing services, but the rental agreement is between the owner and the sailor directly.

2. Property and User Liability

BookABuoy is not responsible for the condition of moorings listed on the platform. Owners are responsible for ensuring their moorings meet all applicable safety and regulatory requirements. Sailors are responsible for ensuring their vessels are appropriately insured and that they have the skills to safely use any mooring they book.

3. Limited Right to Access

We grant you a limited, non-exclusive, non-transferable right to access and use the Site for personal, non-commercial purposes. This right does not include any resale or commercial use of the Site or its contents.

4. Unauthorised Uses

You may not use the Site to:

• Post false, inaccurate, misleading, defamatory, or offensive content
• Infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights
• Distribute viruses or any other technologies that may harm BookABuoy or its users
• Use any robot, spider, or other automated device to monitor or copy content from the Site
• Interfere with or disrupt the Site or servers connected to the Site

5. Eligibility and Account Registration

You must be at least 18 years of age to use this Site. By registering for an account, you represent that you are 18 or older and that all information you provide is accurate and complete. You are responsible for maintaining the security of your account credentials.

6. Proprietary Rights

All content on the Site, including text, graphics, logos, and software, is the property of BookABuoy or its content suppliers and is protected by New Zealand and international copyright laws.

By submitting content to the Site (including mooring listings, photos, and reviews), you grant BookABuoy a non-exclusive, royalty-free licence to use, display, and distribute that content in connection with the operation of the Site.

The Site may contain links to third-party websites. These links are provided for your convenience only. BookABuoy has no control over the content of those sites and accepts no responsibility for them.

12. Limitation of Liability

To the maximum extent permitted by New Zealand law, BookABuoy shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or the services provided through it.

13. Disclaimers
